DMCA & Copyright Policy

Studio Tools respects intellectual-property rights. We respond to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512, and to equivalent processes in other jurisdictions.

1. Designated agent

Studio Tools has designated the following agent to receive notifications of claimed copyright infringement under the DMCA:

Our designated agent is registered with the U.S. Copyright Office at copyright.gov/dmca-directory.

2. How to file an infringement notice

To submit a notice of claimed infringement, send a written notice to the designated agent that includes substantially all of the following (17 U.S.C. §512(c)(3)):

  1. a physical or electronic signature of a person authorised to act on behalf of the owner of the exclusive right that is allegedly infringed;
  2. identification of the copyrighted work claimed to have been infringed, or, if multiple works on the Service are covered by a single notification, a representative list;
  3. identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access disabled, with information reasonably sufficient to permit us to locate the material (such as a URL or a description of the Output and the account or render involved);
  4. information reasonably sufficient to permit us to contact the complaining party, including an address, telephone number, and, if available, an email address;
  5. a statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law; and
  6. a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

Notices that do not substantially comply with the above may not result in action. Please consider whether the use complained of may be a fair use or otherwise authorised by law before sending a notice.

3. Counter-notice

If you believe your content was removed or disabled in error or misidentification, you may submit a counter-notice (17 U.S.C. §512(g)) to the designated agent containing:

  1. your physical or electronic signature;
  2. identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled;
  3. a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Studio Tools may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.

If we receive a valid counter-notice, we will forward it to the original complainant and may, subject to the requirements of the DMCA, restore the material in 10 to 14 business days unless the complainant notifies us that they have filed an action seeking a court order to keep it down.

4. Repeat-infringer policy

Consistent with the DMCA and other applicable law, we will, in appropriate circumstances, terminate the accounts of users we determine to be repeat infringers. We may also take action against single instances of clear infringement.

5. Misrepresentations

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents either that material is infringing or that material was removed or disabled by mistake or misidentification may be liable for damages, including costs and attorneys' fees. Please do not file false notices or counter-notices.

6. Non-U.S. claimants

If you are outside the United States and believe your rights are being infringed, we accept notices substantially equivalent to a DMCA notice. We will respond to valid notices under applicable local law, including the EU Digital Services Act and the UK Online Safety Act, to the extent they apply to us.
